11/02/2015 - FERC Order 809 Capacity Release Changes
Re: FERC Docket No. RM14-2-002 Order Establishing Default Interpretations for Capacity Release Contracts (Issued October 15, 2015)
To Shippers:
For April 1, 2016, Panhandle Eastern Pipe Line Company, LP (pipeline) will implement FERC Order No. 809 which provides revised capacity release and nomination timelines for existing cycles and expanded the number of intraday cycles by adding a new Intraday 3 cycle.
Shippers may have already entered into capacity release transactions that span periods before and after April 1, 2016. The Order Establishing Default Interpretations for Capacity Release Contracts provides default interpretations and procedures to implement Intraday 3 recall rights.
Unless the releasing shipper and replacement shipper agree otherwise, the default interpretations for transactions that span a period before and after April 1, 2016 are:
If releasing and replacement shippers do not want to use the default interpretation or are unable to agree to alternative recall rights, they should notify the pipeline by November 13, 2015. Alternative recall rights agreed to by the releasing and replacement shippers will apply in the place of the defaults. If the pipeline does not receive such notification by the releasing shipper, the default interpretation will apply.
If the replacement shipper disagrees with the releasing shipper's designation of alternative recall rights, the replacement shipper should file a complaint with the Commission by December 14, 2015, providing transaction specific justifications for adopting a different contractual interpretation than that designated by the releasing shipper. If the replacement shipper does not file a complaint in this situation, the releasing shipper's designation of alternative recall rights will apply.
For any releases taking place after November 13, 2015, the default interpretations will control unless the parties specify different provisions in the special terms and conditions of their release or notify the pipeline through other procedures.
